What Is the Lemon Law in Miami, Florida?
Florida’s Lemon Law — officially the Motor Vehicle Warranty Enforcement Act — protects new car buyers from vehicles with repeated, unfixable problems.
It applies when:
- Your car is new (or leased new) and under warranty
- It has a defect or condition that substantially impairs its use, value, or safety
- The manufacturer had a reasonable number of attempts to fix it
- The defect started within 24 months of delivery
If your car qualifies, the manufacturer must offer a replacement vehicle or a full refund — including taxes, fees, and other costs.
Does My Miami Vehicle Qualify as a Lemon?
Let’s break it down. You may have a valid Lemon Law claim in Florida if:
- Your car has been in the shop 3+ times for the same problem
- OR it has been out of service 30+ days total for repairs
- AND the problem started within the first 24 months of ownership or lease
- AND it still isn’t fixed after those attempts
Examples of qualifying issues:
- Engine won’t start or stalls
- Transmission slips, jerks, or delays
- Electrical glitches (dead screen, random alarms)
- Safety features fail (airbags, brakes, backup camera)
- Unexplained warning lights
- Leaking fluids or smells
- Car randomly dies at traffic lights
Even if it’s “just a nuisance,” it might still count as a lemon.
What Can I Get If I Win My Lemon Law Case?
The law is on your side — and the manufacturer may owe you:
Refund Package
- Vehicle price +
- Sales tax +
- Registration & title fees +
- Monthly payments already made
- Towing and rental car costs
OR a Replacement Car
- Same make and model, or close to it
- New, clean title
- Manufacturer handles the swap
Attorney’s Fees Paid
The manufacturer pays our fees — you pay nothing upfront.
